A listing agreement is standard paperwork between the listing agents brokerage and the Sellers of the property. This document is much like an employment contact between the Sellers and the Listing Brokerage. This paperwork is completed before the listing can be active as an exclusive listing or an MLS listing. It establishes a framework and appoints the Listing Brokerage to represent the Seller in the sale of the property.
A Listing Agreement will generally include the following;
- Name of Brokerage and name(s) of Seller(s)
- Duration of the Listing Period (start and end date)
- Desired List Price
- Details regarding location of the property (address)
- Amount of total commission
- Any exceptions to the total amount of commission
- Amount of commission offered to a cooperating brokerage (buyers brokerage)
- Details regarding the hold over period
